Please read these Terms of Service carefully before using our website or engaging ORVIAN sp. z o.o. for construction or interior renovation work. By using the website or entering into a contract with us, you agree to these terms unless otherwise agreed in writing.
1. About ORVIAN
These terms are issued by ORVIAN sp. z o.o., a company registered in Poland, with its business address at Mołdawska 5, 02-127 Warsaw, Poland (“ORVIAN”, “we”, “us”). Contact: orvian@op.pl.
Our website orvianconstruction.com provides information about interior renovations, fit-outs, and related construction services in Warsaw and surrounding areas.
2. Use of the website
You may use this website for lawful purposes only. You must not:
- Attempt to gain unauthorised access to our systems, other users’ data, or third-party services linked from the site
- Introduce malware, automated scraping at scale, or activity that disrupts site availability
- Misrepresent your identity or affiliation when contacting us
- Copy, reproduce, or republish substantial content from the site without our prior written consent, except for personal reference or as permitted by law
Information on the website is for general guidance. It does not constitute a binding offer until confirmed in a written quote or contract.
3. Enquiries and quotes
When you submit an enquiry, you agree that the details you provide are accurate to the best of your knowledge. Site visits and quotes are subject to availability and access to the property.
A quote remains non-binding until accepted by both parties in the form we specify (signed agreement, written acceptance, or equivalent). We may revise a quote if the scope changes or if conditions discovered on site differ materially from those assumed during the survey.
4. Contracts and scope
Renovation and fit-out work is governed by the written contract, scope document, and schedule agreed with you. Those documents prevail over general website content if there is any inconsistency.
The scope defines included and excluded works, responsibilities for materials you supply, access requirements, and handover criteria. Variations must be agreed in writing before additional work is carried out.
5. Your responsibilities
To allow us to deliver work safely and on schedule, you agree to:
- Provide timely access to the site and utilities where required
- Obtain or assist with permissions from building management, landlords, or co-owners where applicable
- Make decisions on samples, specifications, and variations within agreed timeframes
- Keep shared areas clear according to the site plan and building rules
- Inform us of known hazards, asbestos, special insurance requirements, or live-in constraints before work starts
Delays caused by late decisions, denied access, or undisclosed conditions may affect schedule and cost in line with the contract.
6. Prices, invoicing, and payment
Prices are as stated in your quote or contract, plus applicable VAT where required by Polish law. Payment milestones and due dates are set out in the contract.
Invoices are payable within the period stated on the invoice unless otherwise agreed. We may suspend work in accordance with the contract if undisputed amounts are overdue, after reasonable notice.
Title to materials may pass to you upon payment or as specified in the contract. Retention or snagging holdbacks, if any, are defined in your agreement.
7. Site conduct, health & safety
We maintain site discipline consistent with applicable health and safety rules and building requirements. You, your occupants, and visitors must follow reasonable site instructions and exclusion zones.
Children and unauthorised persons should not enter active work areas. We are not responsible for loss or damage to personal items left in work zones unless caused by our proven negligence.
8. Quality, defects, and warranty
We perform work with professional skill and in line with the agreed scope. Handover includes a walkthrough and punch list where applicable.
Defects notified within the period and in the manner specified in your contract will be addressed in line with statutory rights and any warranty terms agreed in writing. Cosmetic issues caused by normal use or lack of maintenance are excluded.
9. Limitation of liability
Nothing in these terms limits liability where limitation is not permitted by applicable law, including liability for death or personal injury caused by negligence, or fraud.
Subject to the above, we are not liable for indirect or consequential loss (such as loss of profit or alternative accommodation) except where expressly assumed in the contract. Our aggregate liability arising from website use or from a specific project is otherwise limited to the extent permitted by Polish law and as set out in the relevant contract.
The website is provided “as is”. We do not warrant uninterrupted or error-free operation of the site.
10. Intellectual property
Website content, branding, layouts, and materials we create for marketing remain our property or our licensors’ property unless otherwise agreed. You may not use our name, logo, or project photography for publication without consent.
Project documentation we produce for your contract may be used by you for the purpose of owning, operating, or maintaining the property, as specified in the agreement.
11. Personal data
We process personal data as described in our Privacy Policy, including data you provide in enquiries and during project delivery.
12. Governing law and disputes
These website terms and any non-contractual disputes arising from them are governed by the laws of Poland. Courts in Warsaw shall have jurisdiction unless mandatory consumer protection rules require otherwise.
For business clients, project-specific contracts may specify dispute resolution mechanisms (including amicable settlement before litigation) that apply in addition to these terms.
13. Changes to these terms
We may update these Terms of Service when our services or legal requirements change. The current version is published on this page. Continued use of the website after changes constitutes acceptance of the updated terms where permitted by law. Contractual projects remain subject to the terms agreed at signing unless both parties agree otherwise in writing.
